At a lower level, permitting prosthesis (DC 5165)

Body system: Musculoskeletal SystemRegulation: 38 CFR § 4.71a

Diagnostic Code 5165 covers amputations at the lower leg level where you can still use a prosthetic (artificial limb). This is a fixed rating code, meaning your rating percentage is automatically set based on which specific body part was amputated - there's no range of percentages to choose from. The VA refers you to the amputation rating table in 38 CFR § 4.71a to find your exact rating, which typically ranges from 40% to 100% depending on the location and extent of the amputation.

Rating levels

  • 40% — An amputation that occurs below the knee or below the elbow, where the remaining limb is long enough and in good enough condition to support and use an artificial limb (prosthesis). The cut must leave sufficient healthy bone and tissue so that a prosthetic device can be properly fitted and functionally used for daily activities.
