Body system: Respiratory SystemRegulation: 38 CFR § 4.97DBQ: DBQ ENT Sinusitis, Rhinitis and Other Conditions of the Nose, Throat, Larynx and Pharynx; DBQ RESP Respiratory Conditions (Other than Tuberculosis and Sleep Apnea)

This diagnostic code covers malignant cancers (cancerous tumors) anywhere in your respiratory system - your lungs, bronchi, trachea, or other breathing structures, but not skin cancers. The VA automatically rates any active malignant respiratory cancer at 100% disability while you're receiving treatment or within six months of completing treatment. This 100% rating recognizes that cancer treatment severely impacts your ability to work and function normally.

Rating levels

  • 100% — You qualify for this rating if you have been diagnosed with cancer (malignant neoplasm) anywhere in your respiratory system, which includes your lungs, bronchi (breathing tubes), trachea (windpipe), or other parts of your breathing system. This does not include skin cancers that might occur on the chest or other areas. The rating applies regardless of the stage of cancer or your current symptoms, as long as the cancer affects your respiratory system.
